These Terms & Conditions govern your access to and use of Unlabelled, including our website (https://unlabelled.site), mobile applications, and all related services (collectively, the "Platform").

References to "Unlabelled," "we," "us," or "our" mean Unlabelled and its affiliated entities. References to "you" or "your" mean the individual or entity using our Platform.

By creating an account, accessing the Platform, or using any of our services, you confirm that you accept these Terms and agree to comply with them. If you disagree with any part of these Terms, you must not use our Platform.

We reserve the right to modify these Terms at any time. Changes may be necessary to reflect new features, legal requirements, business operations, or platform updates.

When we make material changes that negatively impact your rights, we'll notify you at least 30 days before implementation via email or through the Platform. For minor changes, we'll update the "Effective Date" at the top of this document.

Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms. If you don't accept the changes, your only remedy is to stop using the Platform and close your account.

To use Unlabelled, you must be at least 18 years old and capable of forming a binding contract. By registering, you represent that all information provided is accurate, current, and complete.

You're responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains up to date

Accounts are non-transferable. You may not sell, trade, or otherwise transfer your account to another party. If you're creating an account on behalf of an organization, you confirm you have authority to bind that organization to these Terms.

Your store name and URL must not:

• Infringe on trademarks, copyrights, or other intellectual property rights
• Impersonate another person, brand, or entity
• Contain offensive, discriminatory, or inappropriate content
• Violate any applicable laws or regulations
• Be registered for the purpose of reselling or domain squatting

We may require you to change your store name if it violates these guidelines or if we receive a legitimate intellectual property claim. Failure to comply may result in account suspension or termination.

Inactive accounts (no login, updates, or traffic for 6+ months) may have their store names reclaimed and made available to other users.

Unlabelled offers both free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) until canceled.

AUTOMATIC RENEWAL: By subscribing to a paid plan, you authorize us to charge your payment method automatically at each renewal period. Your subscription continues until you cancel it.

You can cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period—no partial refunds are provided for unused time.

APP STORE SUBSCRIPTIONS: If you subscribe through a mobile app downloaded from the Apple App Store or Google Play Store, all subscription management—including purchases, renewals, cancellations, refunds, and restoration of purchases—is handled directly by the respective app store and subject to their terms and conditions. You must manage your subscription through your app store account settings, not through Unlabelled. Refund eligibility and policies are determined solely by Apple or Google, as applicable.

We may modify pricing, features, or plan structures at any time. Existing subscribers will receive advance notice of price increases affecting their current plan.

You retain full ownership of all content you upload, including product listings, images, descriptions, and other materials ("User Content").

By uploading User Content, you grant Unlabelled a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display your content solely for the purpose of providing and improving our services.

You warrant that your User Content:

• Is owned by you or properly licensed
• Doesn't infringe any third-party rights
• Complies with all applicable laws
• Doesn't contain malicious code or harmful materials
• Isn't defamatory, obscene, or otherwise objectionable

We reserve the right to remove any User Content that violates these Terms or is reported as inappropriate, without prior notice.

Unlabelled partners with third-party payment processors to handle transactions. We don't directly process, store, or have access to your complete payment information.

When you enable payment features, you agree to our payment processor's terms and conditions. You acknowledge that:

• All transaction information you provide must be accurate
• You're responsible for product pricing and descriptions
• You must fulfill all orders placed through your store
• You handle all customer service and dispute resolution
• We may charge platform fees or transaction fees

Unlabelled is not liable for payment processing failures, delays, or disputes between you and your customers.

All Platform content excluding User Content—including but not limited to software, design, text, graphics, logos, and interfaces—is owned by Unlabelled or our licensors and protected by intellectual property laws.

You may not:

• Copy, modify, or reverse engineer any part of the Platform
• Use our trademarks without written permission
• Create derivative works based on our Platform
• Extract data through automated means (scraping, bots)

You agree not to:

• Use the Platform for illegal purposes or prohibited transactions
• Sell counterfeit, stolen, or unauthorized goods
• Engage in fraudulent or deceptive practices
• Harass, threaten, or abuse other users
• Upload malware, viruses, or malicious code
• Attempt unauthorized access to our systems
• Interfere with Platform operations or security
• Violate any applicable laws or regulations
• Create multiple accounts to circumvent restrictions
• Manipulate reviews, ratings, or engagement metrics

We may suspend or terminate your account immediately if:

• You violate these Terms
• Your account is involved in fraudulent or illegal activity
• We're legally required to do so
• Your account poses security risks to our Platform or users
• We discontinue the Platform or specific services

You may terminate your account at any time by contacting support@unlabelled.site. Upon termination:

• You lose access to your account and all associated data
• Active subscriptions are canceled (no refunds for partial periods)
• Your User Content may be deleted from our servers
• Sections of these Terms that naturally survive termination remain in effect

To the maximum extent permitted by law, Unlabelled and its officers, directors, employees, and agents are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Third-party actions or content
• Unauthorized access to your account or content

Our total liability to you for all claims arising from or related to the Platform will not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

You agree to indemnify and hold harmless Unlabelled from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim warranties of:

• Merchantability and fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy, reliability, or completeness of content
• Security or freedom from viruses or harmful components
• Meeting your specific requirements or expectations

You use the Platform at your own risk. Maintain backups of your content—we're not responsible for any data loss.

The Platform may integrate with or link to third-party services, websites, or applications. These integrations are provided for your convenience only.

We don't control third-party services and aren't responsible for their content, functionality, or practices. Your use of third-party services is governed by their own terms and privacy policies.

We don't endorse, guarantee, or assume liability for any third-party services. Any dealings you have with third parties are solely between you and them.

Our Privacy Policy explains how we collect, use, store, and protect your personal information. By using the Platform, you acknowledge and agree to our data practices as described in the Privacy Policy.

You're responsible for obtaining appropriate consent from your customers before collecting their personal information through your store.

Entire Agreement: These Terms, along with our Privacy Policy and any supplemental terms, constitute the complete agreement between you and Unlabelled.

Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.

No Waiver: Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

Force Majeure: Neither party is liable for delays or failures caused by circumstances beyond their reasonable control.
